Memberia Terms of Service
This document sets forth the terms and conditions for the use of Memberia software, mobile applications, and all related software and services.
All software and services provided under this agreement will be referred to as Memberia.
Any use of any Memberia software or service in any way constitutes acceptance of these Terms of Service.
1. Accounts and User Responsibility
- 1.1. Users can create user accounts and organization/business accounts on Memberia.
- 1.2. Users are obligated to provide accurate, current, and complete information when creating accounts.
- 1.3. Users are responsible for the security of their accounts and all transactions made through their accounts.
2. Organization/Business Accounts, Authorization and Content Ownership
- 2.1. Individuals who have created user accounts can create organization accounts on behalf of the organizations/businesses they represent.
- 2.2. All information and content created, provided, or uploaded by all users associated with an organization account through Memberia for or related to that organization account belongs to the relevant organization/business.
- 2.3. Information created, provided, or uploaded by users outside of this belongs to the user.
- 2.4. If deemed necessary, information belonging to users or organizations may be retained in the system even if deletion is requested or accounts are terminated. This information may be analyzed to improve service quality and provide additional services.
3. Data Collection, Analysis and Privacy
- 3.1. Memberia may collect and analyze information related to user behavior to improve service quality and provide new solutions.
- 3.2. It is guaranteed that information that may reveal user identity or personal information will not be shared outside of Memberia.
- 3.3. Memberia may use statistical data in anonymous or aggregate form.
4. Visible User Information
- 4.1. User profile pictures, names, and/or other user information may be viewed by other users on Memberia.
- 4.2. Memberia determines which information can be viewed by whom and may change this as necessary.
5. Pricing and Payment
- 5.1. Usage fees for the business for which the organization account was created are automatically billed and collected at the time and in the manner agreed upon by the parties, if any, or at the end of each 30-day usage period, until the service is cancelled.
- 5.2. Services may be suspended or terminated when usage fees are not paid, when terms of use are not fulfilled, or when deemed necessary.
- 5.3. Memberia services may not be provided to users and organizations that are likely to fail to pay fees at the end of the usage period, or existing services may be terminated.
6. Backup and Service Continuity
- 6.1. Memberia regularly backs up user data and guarantees the security of data created more than 24 hours ago.
- 6.2. In case of data loss outside the scope of this guarantee, no usage fee will be charged for the 30-day usage period in which the problem occurred. No other rights may be claimed.
7. Security and Unauthorized Access
- 7.1. Users should not share their passwords with others.
- 7.2. If a user notices that their account has been accessed without authorization by someone else, they must notify Memberia within 24 hours; otherwise, all responsibility belongs to the user.
- 7.3. Users may not attempt to access or use other users' accounts without authorization.
8. Access Restrictions by Organization
- 8.1. Organization/business accounts may restrict or block access to user accounts linked to them.
- 8.2. Users accept these restrictions applied by their organizations.
9. Account and Membership Termination
- 9.1. Organizations/businesses may terminate their organization accounts and the association of user accounts linked to the organization account at any time.
- 9.2. Usage fees incurred until the termination date must be paid.
- 9.3. Users may also request to close their accounts; however, the responsibility for fees for the current payment period continues.
10. Web Analytics
- 10.1. Using website analytics tools, information about which website, search engine, or other sources users came to Memberia from may be collected, whether or not the Memberia session is open.
- 10.2. This information is used only for statistical purposes.
11. Committed / Long-Term Purchases
- 11.1. In case of service purchase for more than 30 days at once, the party receiving the service commits to use the service until the end of the relevant period.
- 11.2. Even if membership or user accounts are cancelled before the committed period is completed, the usage fee for the committed period will be collected.
12. Feedback and Suggestions
- 12.1. In order to provide better service, any suggestions, comments, or feedback transmitted by users may be freely used by Memberia without any restrictions.
13. Updates and Changes
- 13.1. Software and services provided by Memberia may be updated, changed, or new features may be added without prior notice.
- 13.2. Users accept interface/functionality changes that may arise as a result of updates.
14. Intellectual Property
- 14.1. Service content, software, design, interface, brand elements, and all materials provided within Memberia cannot be copied.
- 14.2. Unauthorized development/modification cannot be made on these materials and they cannot be used for commercial or individual purposes.
15. Limitation of Liability
- 15.1. Memberia does not pay more than the total membership and service fees paid by users for Memberia as penalty/compensation for any direct or indirect loss/damage.
- 15.2. The user accepts that they use Memberia at their own responsibility.
16. Legal Use
- 16.1. Memberia cannot be used for illegal purposes.
- 16.2. Users commit not to perform any transactions contrary to current legislation.
17. Modification of Terms
- 17.1. These Terms of Service may be updated without the permission or notice of users.
- 17.2. Current Terms come into effect when published on Memberia. Continuing to use Memberia means you accept the updates.
